Medico-Legal Services
Dr Wiltshire provides a comprehensive expert witness service to claimant and defendant solicitors. All work is conducted in accordance with CPR Part 35 and the overriding duty to the court. Reports are typically delivered within 30 days of receiving complete instructions.
Report Types
Breach of Duty
Assessment of whether the standard of care provided fell below that of a reasonably competent consultant anaesthetist. Reports address the Bolam and Bolitho tests and consider the full clinical context.
Causation
Analysis of whether any breach of duty caused or materially contributed to the claimant's injury or loss, addressing factual and legal causation including the 'but for' test and material contribution.
Condition & Prognosis
Assessment of the claimant's current condition, the extent to which it is attributable to the alleged negligence, and the likely prognosis with and without further treatment.
Single Joint Expert
Dr Wiltshire accepts Single Joint Expert instructions and is experienced in producing reports that serve the court's requirement for independent, impartial expert opinion.
How to Instruct

Initial Enquiry
Contact Dr Wiltshire by email with a brief summary of the case and the issues on which expert opinion is sought. If you are uncertain whether the case falls within his expertise, he is happy to discuss before formal instruction.

Formal Instruction
On acceptance, provide a letter of instruction together with the relevant medical records and documentation. Availability and timescales will be confirmed at this stage.

Report Preparation
Dr Wiltshire aims to deliver a CPR Part 35 compliant report within 30 days of receiving formal instruction and all necessary documentation.

Further Involvement
Dr Wiltshire is available for supplementary reports, joint expert meetings under CPR Part 35.12, counsel conferences, and to give oral evidence at trial.
CPR Part 35 Compliance
All reports are prepared in accordance with CPR Part 35, the accompanying Practice Direction, and the Guidance for the Instruction of Experts in Civil Claims.
Dr Wiltshire has undergone formal expert witness training with Bond Solon and understands and accepts the overriding duty of an expert witness to the court. His reports are independent, objective, and uninfluenced by the instructing party.
Reports include the required Part 35 declaration and statement of truth. Instructions are accepted from claimant solicitors, defendant solicitors, and as a Single Joint Expert.
Fees & Turnaround
Dr Wiltshire aims to provide an expert report within 30 days of receiving formal instruction and all necessary documentation.
Fees are charged at an hourly rate commensurate with Dr Wiltshire's seniority and experience. A fee estimate will be provided on receipt of the letter of instruction and papers.
